According to TIME, the state’s top election official has emergency lawsuits drafted in case federal agents attempt to seize ballots or intervene at polling locations.

Here’s the reporting:

  1. The allegation is enormous. The evidence supplied hasn’t substantiated it.
Trump alleged roughly 16,000 noncitizens were registered to vote in Nevada. DHS supplied information on 185 suspect voters. Nevada says its records showed every one was a U.S. citizen. DHS maintains those 185 were only a subset—not its entire case.
  2. The officials running the election are themselves under pressure.
Nevada’s secretary of state says the state received seven voter-related DOJ subpoenas and that he was told he is personally under investigation.
  3. The threat is serious enough to prepare for, but has not yet materialized as a ballot seizure.
Trump declined to rule out sending ICE to polling places, declaring a national emergency, or invoking the Insurrection Act around the midterms. Nevada is preparing to respond immediately.
  4. Even the counting period becomes a vulnerability.
Nevada is pushing for faster results because its election chief fears that delays could be used to build a narrative of fraud and justify interference.

The danger: allegations that remain unsubstantiated could become the pretext for intervention, and the resulting disruption could then be used to cast doubt on the election itself.
